Terms of Service

1. Agreement to Terms

By accessing and using Dispatchify's delivery services (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including customers, drivers, dispatchers, and administrators.

2. Account Registration

To use our Service, you must:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Maintain the security of your password and account
• Be at least 18 years of age or the age of majority in your jurisdiction
• Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Service Description

Dispatchify provides same-day delivery services with three service levels:

• Hot: 1-2 hour delivery for urgent items
• Rush: 3-4 hour delivery for priority packages
• Sameday: Delivery within the same business day

Delivery times are estimates and may vary based on traffic, weather, and other factors beyond our control. We will make reasonable efforts to meet estimated delivery times but cannot guarantee exact delivery times.

4. Pricing and Payment

4.1 Pricing: Delivery fees are calculated based on distance, service level, and package size. All prices are shown before you confirm your order.

4.2 Payment: Payment is due at the time of order placement. We accept major credit cards, debit cards, and approved business accounts.

4.3 Refunds: Refunds are issued for cancelled orders (before pickup) and failed deliveries due to our error. Refunds typically process within 5-7 business days.

4.4 Disputes: Payment disputes must be submitted within 30 days of the transaction date.

5. Order Cancellation

You may cancel orders with “Pending” or “Assigned” status without penalty. Once a driver has picked up your package, cancellation is no longer possible.

Refunds for cancelled orders are processed automatically and returned to the original payment method.

6. Prohibited Items

The following items are prohibited from delivery:

• Illegal substances or controlled substances without proper authorization
• Hazardous materials or flammable substances
• Weapons, firearms, or explosives
• Live animals (except service animals with proper arrangements)
• Perishable items requiring refrigeration (unless using specialized service)
• Items exceeding size or weight limits specified for your service level
• Stolen goods or items obtained illegally

We reserve the right to refuse delivery of any item at our discretion. Violations may result in account termination and reporting to authorities.

7. Liability and Insurance

7.1 Coverage: All deliveries include basic liability coverage up to $100. Additional insurance can be purchased for high-value items.

7.2 Damage Claims: Claims for damaged items must be reported within 24 hours of delivery with photographic evidence.

7.3 Lost Items: Claims for lost items must be reported within 48 hours. We will investigate and provide resolution within 7 business days.

7.4 Limitations: Our liability is limited to the declared value of the item or $100, whichever is greater, unless additional insurance was purchased.

8. User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Harass, abuse, or harm drivers, dispatchers, or other users
• Attempt to gain unauthorized access to our systems or user accounts
• Interfere with or disrupt the Service or servers
• Transmit any viruses, malware, or harmful code
• Impersonate any person or entity
• Use automated systems to access the Service without permission

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Dispatchify and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our Service without express written permission.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. All provisions that should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. DISPATCHIFY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

12. Limitation of Liability

IN NO EVENT SHALL DISPATCHIFY, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dispatchify operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by email or through a notice on our Service.

Your continued use of the Service after any changes constitutes acceptance of the new Terms.
